After you and your soon-to-be-former spouse have negotiated and formalized a settlement agreement, one of your attorneys will present the document to the court. The court may or may not approve your agreement. Once that agreement is approved and made law by way of a final judgment and decree, however, it is still subject to modification.

Modification of Alimony

Perhaps your or your ex-wife's or ex-husband's income has changed. Perhaps one of you has remarried, resulting in a change in assets or expenses, and the alimony agreed upon in the settlement agreement is no longer appropriate.

Modification of Child Custody and Visitation

Perhaps a custodial or non-custodial parent plans to move out of state, and wishes to request a revision of child custody and visitation orders. Less frequent but lengthier time with the non-custodial parent may make sense when parents live far apart.

When a Custodial Parent is Absent or Unable to Care for Children

Or perhaps a custodial parent has developed serious health problems, or been sent abroad in the military. In such cases, a temporary or permanent revision of child custody may be necessary. A new court order will protect the legal rights of all parties: the child, the custodial parent, and the non-custodial parent.
