Mediation
Mediation is an ADR process in which a third-party neutral or mediator facilitates an agreement between disputing parties. The third-party neutral is there only as an objective facilitator and will draft a divorce agreement outline if the parties reach one. Mediation is a voluntary process, but if the parties reach an agreement, it will likely be binging. Thus, good representation at mediation is critical. Mediation sessions are confidential and if mediation is unsuccessful, anything disclosed during the mediation cannot be brought up at trial. However, a party should take care not to share too much information at mediation.
Although parties can participate in mediation without representation, it is important to note that mediators are not required to have a background in law and cannot give legal advice. Thus, it is extremely advantageous for a party to have skilled legal representation at the mediation.
